The Department of Home Affairs has a very thorough process for assessing Partner Visa applications. Usually, they will require a lot of evidence and information in order to be satisfied that the applicant’s relationship is genuine.

 

Partner Visas can also be expensive, so it is important that when you do submit your application, it is presented as best as possible in order to maximise your chances of success and not have to pay more money to reapply later on.

1. PARTNER VISAS (onshore)

Onshore Partner Subclass 820/801

Subclass 820 - Temporary Partner Visa

About this Visa (820)

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (subclass 801).

Temporarily while the Department processes your permanent Partner visa (subclass 801) application or it is withdrawn.

From AUD7,850 for most applicants. From AUD1,310 for Prospective Marriage visa (subclass 300) holders. 

 

You pay for the temporary and the permanent visa at the same time.

  • 75% of applications: 22 months
  • 90% of applications: 32 months

There are various eligibility requirements for this Visa, but in general, you must:

 

  • be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen
  • be in Australia when you apply for this visa and when we decide your temporary visa application. Family who apply with you must also be in Australia

Subclass 801 - Permanent Partner Visa

About this Visa (801)

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently. It is usually only for people who currently hold a temporary Partner visa (subclass 820).

This visa will allow you to permanently stay in Australia, given that you satisfy all the Department’s eligibility requirements.

You paid for this visa when you made your combined application for the  temporary and permanent partner visas.

  • 75% of applications: 11 months
  • 90% of applications: 17 months
  • live, work and study in Australia indefinitely
  • sponsor eligible family members to come to Australia
  • apply for Australian citizenship if eligible

2. PARTNER VISAS (offshore)

Offshore Partner Subclass 309/100

Subclass 309 - Partner (Provisional) Visa

About this Visa (309)

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (subclass 100).

Temporarily, until we decide your permanent Partner (Migrant) visa (subclass 100) application or the application is withdrawn.

From AUD7,850.

  • 75% of applications: 18 months
  • 90% of applications: 27 months

There are various eligibility requirements for this Visa, but in general, you must:

 

  • be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen
  • be outside Australia when you apply for this visa

Subclass 100 - Partner (Migrant) Visa

About this Visa (100)

The visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen, live in Australia permanently. It is usually granted to people who hold a temporary Partner visa (subclass 309).

This visa will allow you to permanently stay in Australia, given that you satisfy all the Department’s eligibility requirements.

You will have paid for this visa when you applied for the combined temporary and permanent partner visas.

  • 75% of applications: 14 months
  • 90% of applications: 20 months
  • live, work and study in Australia indefinitely
  • sponsor eligible family members to come to Australia
  • apply for Australian citizenship if eligible

3. PARTNER VISAS (marriage)

Prospective Marriage Subclass 300

Subclass 300 - Prospective Marriage Visa

About this Visa (300)

This visa lets you come to Australia to marry your prospective spouse and then apply for a Partner visa.

Between 9 and 15 months from date of grant of visa.

From AUD7,850.

  • 75% of applications: 28 months
  • 90% of applications: 35 months
  • stay in Australia for between 9 and 15 months from date of grant of visa
  • work in Australia
  • study in Australia at your own expense

There are various eligibility requirements for this Visa, but in general, you must:

 

  • be 18 years old or older
  • be sponsored
  • intend to marry your prospective spouse before the visa period ends
  • be outside Australia when you apply

You may be eligibile for a refund of your Visa Application Charge if:

 

  • your Prospective marriage visa ceased while you were outside Australia, and
  • you were not able to enter Australia because of COVID-19 travel restrictions, or
  • we extended your visa because of the regulations made on 10 December 2020 and you wish to cancel that visa
